Copyright Objection Reply

Answer an objection or a third-party challenge.

Two different things are called a copyright objection. The registry may issue a discrepancy letter over the application itself — an incomplete statement of particulars, a missing no-objection from the author or the employer. And a third party may object during the mandatory thirty-day window after filing.

A third-party objection is the more serious. Both sides are heard by the registrar, and the application does not proceed until it is resolved.

Most registry discrepancies are answerable with the right no-objection certificate — from an author where the applicant is not the author, or from the trademark proprietor where an artistic work is also used as a mark.

  • Evidence of authorship and date of creation

Questions

What is the thirty-day objection window in copyright?

Every copyright application is open to third-party objection for thirty days from filing. The registrar cannot proceed until it expires, which is why even an unopposed copyright registration is never immediate.
