Design Registration

Protect how the product looks, for ten years.

A design registration protects appearance rather than function: the shape, configuration, pattern or ornamentation of an article as judged by the eye.

It must be new and not previously published anywhere. Publishing the design — including showing it at a trade fair or putting it on a website — before filing destroys its novelty.

Protection runs ten years and can be extended by five. It sits alongside a trademark, which protects the brand, and a patent, which protects the function.

Questions

Can I register a design I have already sold?

No. Prior publication anywhere in the world destroys novelty, and that includes your own website, catalogue or trade-fair stand. File before you show it.
