Template agreements downloaded from the internet are usually drafted for a different legal system. Indian courts treat non-compete clauses after employment as void under section 27 of the Contract Act, for instance, so a clause copied from a US contract is unenforceable however firmly it is worded.

Questions

Are non-compete clauses enforceable in India?

Not after employment ends. Section 27 of the Indian Contract Act voids agreements in restraint of trade, and courts consistently strike down post-employment non-competes. Confidentiality and non-solicitation clauses are enforceable, which is where the protection actually comes from.
